A man who police say fired 30 shots during a day-long stand-off in Cooksburg waived his hearing.

The attorney says he doesn’t think his client had a “specific intent to kill.”
John MacBeth, 47, Cooksburg, is facing 30 counts of attempted homicide after police say he fired repeatedly at officers in riot gear from his apartment above the store at MacBeth’s Cabins in March.
The standoff damaged the second floor of the business owned by his cousin.
Several troopers were in court ready for a hearing today.
The attorney says his client has a history of alcohol abuse, but can now dry out in jail, and he also thinks the charges should be reduced.
“If, for example, you do not have bullet strikes hitting vehicles where troopers are standing, or if no one was actually injured in this, or if you’ve got no evidence that he was actually firing at the troopers,” says defense attorney Patrick Nightingale.
Police said MacBeth started shooting after they sent in tear gas and cut the power off. His bail on two cases remains at $550,000, according to court records.
“When family members came to the house, he didn’t want to be bothered, when the police came he didn’t want to be bothered, and unfortunately that caused a radical escalation on both sides,” says Nightingale.
