Penn State’s legal team is seeking a stay in Mike McQueary’s whistleblower lawsuit.
The former assistant coach, who said he told administrators he witnessed Jerry Sandusky abusing a boy in a shower in 2001, is seeking $4 million in damages.
The university’s argument Tuesday is that both former administrators, Gary Schultz and Tim Curley- to whom McQueary reported the incident- invoked their Fifth Amendment rights.
Penn State wants to wait on this civil case until the two are tried criminally on charges of child endangerment and failure to report.
