A judge will decide whether or not Jerry Sandusky’s quest for a new trial can continue.

This, after the former Penn State Football coach was back in a Centre County courtroom Monday morning.

“Read what has been written and have the courage to present it,” Sandusky yelled, as he walked into court Monday.

He’s fighting for a new trial through a Post Conviction Relief Act petition and his attorneys are now pushing for an evidentiary hearing to bring forward witness testimony. Sandusky’s attorneys want to use these witnesses to prove that Sandusky’s trial was rushed and inadequately prepared by the original defense team.

Monday, the judge questioned whether or not the defense has enough evidence, by law, to prove their theory in an evidentiary hearing.

There are 25 certified witnesses, including Joe Amendola and members of the original prosecution team.

Al Lindsay, Sandusky’s attorney, said some witness certifications are stronger than others, a point Judge Cleland pushed Monday.

The judge allowed the defense to add an additional witness to their list. They’ll ask the state’s Attorney General, Kathleen Kane, to come forward for testimony. She claims lead prosecutor Frank Fina leaked secret grand jury information about Sandusky’s case to the media.

They have 10 days to seek her testimony.

No word on when the judge will make his decision about whether or not an evidentiary hearing will be granted.
